SumerSports Health Data Privacy Policy

SumerSports values the security and privacy of your health data. This SumerSports Health Data Privacy Policy (the “Health Data Privacy Policy”) applies to the collection, use, disclosure and other processing of your health data (“Health Data”) by SumerSports LLC or any of its affiliates (collectively, “Sumer,” “we,” “us” or “our”), to the extent such collection, use, disclosure or other processing is subject to applicable health privacy laws; provided that, in the event we have agreed to any terms governing the use, disclosure or other processing of your Health Data that are different from those set forth in this Health Data Privacy Policy (whether as part of an authorization, consent or other similar form or instrument), then such terms, instead of the terms set forth herein, shall govern with respect to such use, disclosure or processing.
Health Data shall include all health data that constitute “consumer health data” or other similar terms, as such terms are defined under any applicable laws and include all types of health data described under the heading Health Data We Collect below.
We reserve the right to update or modify this Health Data Privacy Policy at any time in our sole discretion, including without limitation, in order to comply with applicable law, and will post the effective date of any such updates or modifications at the top of this Health Data Privacy Policy.

To the extent permitted by applicable law, we retain your Health Data as long as such information is needed for the purposes for which we obtained it, in accordance with the provisions of this Health Data Privacy Policy.

In order to protect your privacy and security, we must verify your identity prior to completing any request that you may submit with respect to your Health Data. We will verify your identity by asking you to provide certain information that we have already collected from you to confirm that it matches our records.
While we will make reasonable efforts to accommodate your request, we also reserve the right to impose certain restrictions and requirements on such requests, if allowed or required by applicable law.
You may designate an authorized agent to make a request on your behalf pursuant to this Health Data Privacy Policy or applicable law. Prior to completing a request made by such an authorized agent, we require that you provide your authorized agent with written permission to submit such a request and require that you or your authorized agent provide us with a copy of such written permission. Additionally, we require that you verify your identity pursuant to the procedure described above.
In case of your request to withdraw consent to our collection and sharing of your Health Data, such withdrawal will only apply to the collection and sharing of the relevant information after such request has been processed and accepted in accordance with the terms herein.
You may have the right to appeal under applicable law any refusal by us to take action on your request within a reasonable period of time after your receipt of our decision. We may update this Health Data Privacy Policy at any time and without prior notice to you to reflect any changes to our information practices or to comply with applicable laws or regulations. We will post a notice on our website at SumerSports.com to notify you of any significant changes to this Health Data Privacy Policy and indicate at the top of the notice when it was most recently updated.
